Terms and Conditions
The legislation of the Republic of Latvia stipulates that the owner of an online store must specify the terms of delivery and return of goods, as well as the right of withdrawal. Such a provision is called a distance contract (Cabinet Regulations).
Distance contract
The goods offered in this online store are provided by SmartFeet RIX SIA, Reg. No.: 40203307684, legal address Vasarnīcu iela 1b dz.3, Saulkrasti, LV-2160, on the one hand, hereinafter referred to as the Seller, and the person placing the order, hereinafter referred to as the Buyer, on the other hand, conclude the following Agreement:
The Seller undertakes to sell and deliver goods to the Buyer in accordance with the Buyer's order.Delivery and payment procedure
The Buyer places an order for goods through this website, indicating the type and quantity of goods to be ordered. The payment currency on the site is euro. Purchases can be paid for by choosing the following payment methods provided by the payment platform makecommerce.lv, Maksekeskus AS, or PayPal:
- Latvian internet bank payments: Swedbank, SEB, Citadele, Luminor, and Revolut
- Visa/Mastercard card payments
NB! When using the internet bank payment method, confirm the order and click the “Return to merchant” button.
Personal data necessary for making payments are transferred to the licensed payment institution Maksekeskus AS.
The Agreement enters into force upon successful payment to the online store's bank account. If for any reason it is not possible to fulfill the order, the Buyer will be informed and the paid amount will be refunded as soon as possible, but no later than within 14 days after receiving the notification.
Purchased goods are delivered using: parcel partners, courier, or pickup from the store. All fees and taxes that must be paid to receive the shipment at the delivery destination must be covered by the Buyer. Delivery costs are shown before confirming the order. Purchased goods are delivered to the address specified by the Buyer within 2-3 business days and a confirmation is sent to the Client by e-mail. In exceptional cases, we reserve the right to deliver goods within up to 45 calendar days, informing the client accordingly..Right of withdrawal
The Buyer has the right to refuse the goods within 14 calendar days from the moment of receiving the goods by sending a withdrawal letter to the Seller. The Seller will send a withdrawal letter form to the Buyer by e-mail upon the Buyer's request to the e-mail: [email protected].The Buyer must return the goods to the Seller within 7 days after sending the withdrawal letter. All expenses related to returning the goods to the Seller at Skanstes iela 50, entrance No.5, Riga, LV-1013, are covered by the Buyer.
The Buyer cannot exercise the right of withdrawal if:
- the ordered goods, by their nature, cannot be returned, or they spoil quickly or are quickly consumed;
- the ordered goods are made specifically for the Buyer according to an individual order;
Section 12, sixth part, of the Consumer Rights Protection Law of the Republic of Latvia states that "the consumer is responsible for preserving the quality and safety of the goods during the period of exercising the right of withdrawal". The Seller reserves the right to refuse the Buyer the right of withdrawal or to withhold compensation if the goods are damaged, carelessly used during use, or if the instructions are not followed, if the original packaging of the goods is lost, or if the packaging is significantly damaged.
The Seller has the right to withhold payment until the moment when the Seller has received the goods or proof of return from the Buyer. If the Buyer has chosen a delivery method other than the cheapest one offered by the online store, the online store is not obliged to compensate for the excess delivery costs.
Refunds are made using the same means of payment as the client used for the transaction. The Seller returns the amount paid for the goods within 7 calendar days from the moment of return of the goods. The Seller reserves the right not to refund the payment for goods and services until the Client has returned the goods or submitted documents confirming the return of the goods.
The Seller reserves the right to refuse the Client the right of withdrawal or to withhold compensation if the goods are damaged, carelessly used during use, or if the instructions are not followed, if the original packaging of the goods is lost, or if the packaging is significantly damaged.The online store is not responsible for delays in the fulfillment of obligations or non-fulfillment, or any other failure to perform, arising from circumstances and obstacles beyond the reasonable control of the online store.
The online store reserves the right to refuse to sell goods and to request the return of goods from the Buyer if the price indicated in the online store is significantly lower than its market price due to an error.
Data processing
By entering the necessary information and placing an order, the Buyer confirms that he/she has read and agrees that the data provided will be used so that the Seller can accept the Buyer's order and deliver the goods in accordance with the requirements of the laws of the Republic of Latvia. By entering the information, the Buyer agrees that notifications related to the processing of the Buyer's order will be sent to the specified e-mail address.
The online store processes only those personal data that the buyer has entered when ordering goods, such as name, surname, e-mail, etc.
The online store transfers personal data to the provider(s) of transport services to ensure the delivery of goods.
If you have clearly agreed to receive our marketing messages, including news, we may from time to time contact you by sending information about our services and latest offers. For this purpose, we may process your e-mail address provided when subscribing to marketing communication. The Buyer has the option to opt out of marketing messages by notifying us by writing to [email protected]
Dispute resolution procedure
In matters not specified in these terms and conditions, the Buyer and the Seller undertake to comply with the regulatory enactments in force in the Republic of Latvia.
The parties resolve all disputes between the Seller and the Buyer through mutual negotiations or correspondence. If the dispute cannot be resolved through negotiations or correspondence, the Parties will resolve the dispute in the court of the Republic of Latvia, in accordance with the regulatory enactments of the Republic of Latvia. Disputes between the Buyer (consumer) and the Seller can be submitted for resolution to the Consumer Rights Protection Centre or the court of the Republic of Latvia.
The Buyer also has the right to apply to the dispute resolution institutions of the European Union.
